General conditions for distance selling
1. GENERAL REMARKS
This document, together with the additional information available on www.bettinavermillon.com (hereinafter referred to as the "site") constitute the general terms and conditions of sale (hereinafter referred to as the "GTC") applicable between the user of the site (hereinafter referred to as "You" or the "User") and BETTINA VERMILLON, a simplified joint stock company whose registered office is located at 5 rue du Chevalier de Saint-George, 75008 Paris, France, and which is registered under number 751 841 792 RCS Paris (hereinafter referred to as the "Bettina Vermillon" or the "Company"). It governs the contractual relationship between Bettina Vermillon and you, in particular with regard to any purchase made on or via the site (hereinafter referred to as the "Transaction"). At the time of the verification of your order, by clicking on the "VALIDATE" button, you have read and fully and unreservedly accept these GTC.
You must read the T&Cs carefully before proceeding with any transaction on the site. You are bound by the version of the T&Cs in force at the time of your transaction and when you submit an online form (hereinafter referred to as the "Form") materializing your order of products on the site (hereinafter referred to as the "Order").
The description of the products is that published on the site at the date of the order.
The images of the products are provided solely for the information of the users and do not constitute a contractual representation of the characteristics of the products, in particular with regard to appearance, general colour or any other characteristic.
The images of the products on the site are provided for information purposes only on the collections of Bettina Vermillon and their publication on the site does not constitute an offer to sell.

All orders placed on the website are sent in a Bettina Vermillon box containing various accessories (protective covers, replacement tips for shoes...) all carefully packed.

In the case of an order through the customer service, the products you have ordered will be delivered to you with the present GTC. If you do not wish to keep your products, you can return your package by following the procedure described in article 11. Upon ordering, the GTCs will be deemed accepted and will become enforceable against you.
Any order implies acceptance of the prices and description of the products available for sale.
2. MODIFICATION OF THE GCV
Bettina Vermillon may at any time decide to modify its GTC without prior notice, it is therefore your responsibility to read and accept the GTC at each order you place on the site.
3. OPERATION OF THE SITE
The website is a secure online platform allowing the online purchase of items offered by the company Bettina Vermillon (hereinafter referred to as the "Product(s)")
The description of the products is that published on the site at the date of the order.
The images of the products are provided solely for the information of the users and do not constitute a contractual representation of the characteristics of the products, in particular with regard to appearance, general colour or any other characteristic.

5. AVAILABILITY OF PRODUCTS
The publication of product descriptions on the site constitutes only an invitation to make an offer. By placing an order, the user makes an offer to Bettina Vermillon, which has the right but not the obligation to accept or reject it, at its sole discretion and in particular depending on the availability of the product ordered. Please note that Bettina Vermillon cannot be held responsible for the non-availability of a product until the order has been accepted.
6. PRICES
The price of the products is indicated in euros (€) including all taxes.
You acknowledge and accept that the products may be subject to customs duties, postal services, tax services or any additional costs related to the transport, import or delivery of products. These taxes are beyond the control of Bettina Vermillon. You agree, if applicable, to bear these additional costs in full when you click on the "VALIDATE" button and accept the GTC by doing so.
Bettina Vermillon reserves the right to change the price of its products at any time, however the prices charged are those displayed on the site at the time of the order and cannot be changed once the order has been placed.
7. ORDER
Your order is subject to the availability in stock of the product(s) ordered. The products selected in your basket are reserved by computer for a limited period of time when you click on the "VALIDATE" button. This computer reservation is however subject to confirmation by the Bettina Vermillon team to set aside the product(s). The company cannot be held responsible in the event of a product not being available when ordered. In this case, the company will cancel the order and your payment will be cancelled and re-credited.
The products are intended for your personal use only and not for resale. By placing an order, you warrant that you will use the product for personal use only.
Bettina Vermillon, at its sole discretion, reserves the right not to confirm an order, in particular, and without limitation, in the event that it suspects the user of placing an order for resale purposes.
To place an order on the site, you must fill in the form and follow the site's instructions, in particular by reading and accepting the GTC.
When filling out the form, you must specify the payment method that will be used to complete the transaction in response to your order, subject to acceptance by Bettina Vermillon. For each order, the name, billing address, delivery address and payment method used are verified.

Only personal payment cards (excluding business cards) are accepted whose holder is a natural person residing at the billing address.
The billing information declared at the time of your order must correspond to the holder of the payment card used, whom Bettina Vermillon must be able to contact directly if necessary, in order to request additional information. The above-mentioned additional verifications may result in an additional delay of five (5) working days to be added to the delivery time. In case this condition is not met and/or Bettina Vermillon is unable to reach the cardholder, Bettina Vermillon reserves the right to cancel your order.
If you prefer to place your order through the Customer Service, Bettina Vermillon invites you to contact it under the conditions mentioned in article 1 of these GTC. Please note that no bank details should be sent by email or by the contact form to the customer service. The person in charge of your order at the customer service will request - by phone or email - the information required by the banking institutions in order to allow the payment of your order.
Your payment card will only be debited at the time of shipment of your order, after verification of your data, upon receipt of the authorization provided by your bank and after acceptance of your order by Bettina Vermillon.
Subject to the acceptance of your order, Bettina Vermillon will send You a confirmation of the conclusion of the transaction to the e-mail address You provided when ordering.
The transaction will only be deemed concluded when Bettina Vermillon has confirmed its acceptance by sending you the confirmation e-mail, including a summary of the order, the price of the products, the date and time of the order, the amount of shipping costs, taxes and customs duties, the method of payment chosen by you and the selling price of the product will be collected.
It is specified that any order placed on a holiday or a weekend will be processed on the next working day.
If you wish to cancel or modify your order before the ordered products are shipped, you can contact Bettina Vermillon within 24 hours at the following address: bettina@bettinavermillon.com. Bettina Vermillon will make its best efforts to respond favourably to your request. However, this request will constitute a simple wish and Bettina Vermillon cannot guarantee that the order will be cancelled or modified.
8. GIFT CARD
The gift card is valid for one year from the date of purchase. You have a 14 days retraction period after the purchase, after this period the gift card will not be refunded.
The Bettina Vermillon gift card can only be used once and the unspent amount cannot be refunded or used for a second purchase. If the amount of your order is higher than the value of your gift card you will have to pay the rest with another payment method.
If you return a product purchased with our gift card, the amount of the product will be refunded.
Our gift cards are personal and are not transferable to a third party. They are not returnable or exchangeable for cash or other means of payment.
Bettina Vermillon is not responsible for sending a virtual gift card to an incorrect or non-existent email address. In this case, only the responsibility of the buyer is engaged. Bettina Vermillon is not responsible for theft, loss, destruction or unauthorized use of a gift card.
Bettina Vermillon reserves the right to cancel an order in case of suspected fraud or abusive behavior.
Shipping costs are offered for printed gift cards.
9. PACKAGING
All orders placed on the website are sent in a Bettina Vermillon box containing various accessories (protective covers, replacement tips for shoes...) all carefully packed.
10. CANCELLATION
10.1 PRODUCT RETURN REQUEST
In accordance with Articles L.121-16 and following of the Consumer Code, the customer has a period of 14 days from the day of delivery of the product purchased on the site to notify the customer service of the desire to return the product.
Bettina Vermillon can accept the return of products in their original condition and proceed with the refund if the original purchase invoice and the return authorization number are attached to the product. Before returning the product concerned, you must contact the Customer Service at sav@bettinavermillon.com.
Bettina Vermillon does not accept any returns of products that appear to have been used or that have been damaged.
If you return them with a damaged outsole, Bettina Vermillon reserves the right to refuse their return or to accept it but deducting from your refund the costs of pick-up and repair.
10.2 METHOD OF RETURNING PRODUCTS
You have thirty (14) days from the date of receipt of your order to return the product(s) concerned.
All returned products must be protected and packaged in their original box and carton and be accompanied by all the accessories present when the package is opened, such as, if applicable, depending on the nature of the product: The pouch, the replacement tips, etc.. If not, you will be charged.
Place the original box(es) in the shipping carton along with the original purchase invoice, carefully close the shipping carton, stick the return label on the shipping carton and ship the pair directly to a post office.
You also agree to take special care in packaging the product you are returning. If the returned product has been damaged due to improper packaging, Bettina Vermillon reserves the right to refuse the return or to accept it, but deducting the costs of handling and repair from the amount to be credited back to you.
After receipt of the products returned by you, and provided that the conditions for return are met, Bettina Vermillon will notify you by e-mail that the total or partial refund of the amount of your order is being processed. A refund will then be made in the same way as the initial payment. Depending on your bank, the refund may take up to 15 (fifteen) working days following the confirmation by email sent by Bettina Vermillon.
11. DEFECTS
Bettina Vermillon ensures that high quality standards are met without interruption in the manufacture of all Products. Each product is checked before shipment.
However, if your product has a defect, please contact Customer Service immediately, and no later than five (5) days after the delivery date, at: sav@bettinavermillon.com
In such a case, You must indicate in your e-mail the alleged defect and attach all documents supporting Your request (detailed photos of the Product, date of purchase, Order number, etc.).
After examining these elements, Bettina Vermillon reserves the right to recover the Product in order to conduct a physical inspection.
In the sole case of a recognized defect, Bettina Vermillon undertakes either to replace the defective Product within the limits of available stocks, or to partially or fully reimburse You for the purchase price, depending on the nature of the defect.
Bettina Vermillon reserves the right to refuse to follow up on a late claim, a claim relating to a defect for which You are responsible or if it is an imperfection due to the nature of the product (some products may have small irregularities and/or roughness inherent to their manufacturing process or the material used).
12. LIMITATION OF LIABILITY
Subject to any liability arising from a defect as defined above, Bettina Vermillon shall only be liable for direct damages resulting from gross negligence or intentional misconduct, whether in connection with the conclusion or execution of the transaction, or in connection with your use of the Site and within the conditions and financial limits of its insurance policy. Any guarantee is excluded in case of damage of external origin or consecutive to a misuse, a non-conforming use, a negligence or a defect of maintenance as in case of normal wear of the Product.
The company has, for the access to the site and the ordering process, only an obligation of means. The responsibility of Bettina Vermillon can not be held liable for damages related to the use of the Internet, including a break in connection, external intrusion or the presence of computer viruses or any fact qualified as force majeure. Moreover, the company cannot be held responsible in the event that the order is not completed or if it is prevented from fulfilling any of its obligations due to a case of force majeure preventing the completion of the order.
In addition, the customer must inform the brand of the change of his coordinates, more precisely of a possible change of address without which the brand could not be held responsible for delivering the parcel to an address that is no longer the customer's address. It is therefore the customer's responsibility to keep all of his contact information up to date.
In summary, the responsibility of Bettina Vermillon can not be engaged as long as the damage caused is not proven to be a failure on the part of the brand to its obligations.
13. INTELLECTUAL PROPERTY
All elements of the site, whether visual or audio, as well as the products, are protected by copyright, trademarks or patents. They are the exclusive property of Bettina Vermillon. As such, and in accordance with the provisions of the code of intellectual property, only the use for exclusively private use is authorized. Any total or partial reproduction of the site and products is strictly prohibited and engages the responsibility of its author.
14. DISPUTES
The present GTC are subject to French law. In case of dispute, the company and the customer will resolve any difference amicably.
In case of failure of the discussions, the competent court is that of the defendant's residence.
